Terms of Service

By downloading, installing, or using iWellny ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and iWellny ("we", "us", or "our"). We reserve the right to modify these Terms at any time, and we will notify you of significant changes through the App.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.

You may:

• Use the App on devices you own or control
• Create and save personal sound mixes
• Record memory sounds for personal use
• Access premium features with a valid subscription

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without permission
• Share your subscription credentials with others
• Attempt to bypass any security measures

The ambient sounds included in iWellny are sourced from:

• Freesound.org — Only sounds licensed under Creative Commons Zero (CC0 1.0) public domain dedication
• Pixabay — Sounds under the Pixabay Content License (royalty-free for commercial use)
• Original recordings — Created specifically for iWellny

All bundled sounds are properly licensed for use within the App. You may use these sounds as part of the App's functionality but may not extract, redistribute, or use them outside of the App.

Premium Subscription:

• iWellny offers optional premium features through auto-renewable subscriptions
• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

Free Trial:

• If offered, free trials automatically convert to paid subscriptions unless canceled
• Any unused portion of a free trial is forfeited when purchasing a subscription

Refunds:

• All purchases are processed by Apple through the App Store
• Refund requests must be submitted to Apple directly
• We cannot process refunds directly

• Health data from HealthKit is for informational purposes only
• HRV, heart rate, and sleep data are estimates and may not be accurate
• The App does not provide medical advice
• Consult a healthcare professional for medical concerns
• Do not use the App while driving or operating machinery
• If you experience any discomfort, stop using the App immediately

You retain ownership of content you create using the App, including:

• Memory sound recordings
• Custom sound mixes and presets
• Journey collections
• Personal wellness goals and notes

You are solely responsible for any content you create. Do not record audio in locations where recording is prohibited or where you do not have permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The App is provided "AS IS" without warranties of any kind
• We do not guarantee the App will be error-free or uninterrupted
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months
• We are not responsible for any health outcomes related to App use

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

You may terminate your use of the App at any time by deleting it from your device and canceling any active subscriptions.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
